Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Apnea Assist application and related services (the "App"), operated by PulmoWise Ltd, a company registered in England and Wales ("PulmoWise", "we", "us" or "our"). By creating an account or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the App. The App is intended for personal, non-commercial use by adults seeking general education and wellness support relating to sleep and respiratory health.

3. Account registration

  • You must provide accurate and complete information when registering.
  • You are responsible for maintaining the confidentiality of your password.
  • You are responsible for all activity that occurs under your account.
  • You must notify us promptly of any unauthorised use of your account.
  • You must verify your email address before accessing the App.

4. Subscription and Premium membership

4.1 Plans

The App is offered as a free tier and a paid "Premium" subscription. Premium pricing is £7.99 per month or £69.99 per year, billed in advance and renewing automatically until cancelled. Prices may change with reasonable notice.

4.2 Free trial (7 days)

  • New users may start one 7-day free trial of Premium.
  • You will not be charged during the trial.
  • If you do not cancel before the trial ends, your selected paid plan starts automatically.
  • Only one free trial is permitted per user.

4.3 Billing and cancellations

  • Payments are processed by a third-party payment provider acting as merchant of record.
  • You may cancel at any time via your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.
  • Except where required by law, fees already paid are non-refundable.
  • UK consumers have statutory cancellation rights; by starting Premium you expressly agree to immediate access to digital content and acknowledge you may lose your right to withdraw once the service has begun.

5. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose or in any way that infringes the rights of others.
  • Share your account or provide false information.
  • Attempt to access another user's account or data.
  • Reverse engineer, decompile or extract source code from the App.
  • Use the App to send spam, malware or harmful content.
  • Scrape, harvest or otherwise abuse the AI features or transactional emails.

6. User-generated content

You retain ownership of any content you submit (such as health logs, notes and support messages). You grant PulmoWise a worldwide, royalty-free licence to use that content solely to provide the App's features to you (including generating AI insights and reports). You confirm you have the right to submit any content you provide.

7. AI-generated content

The App uses artificial intelligence to generate educational responses, coaching messages and personalised wellness summaries. AI output may be incomplete, outdated or incorrect. It is provided for general educational purposes only and must not be relied upon as medical advice. Do not share confidential information about other people in your AI prompts.

8. Health and medical disclaimer

  • Apnea Assist is an educational and wellness application.
  • It does not diagnose, monitor, treat, cure or prevent any disease.
  • It does not interpret medical measurements such as blood pressure or oxygen saturation.
  • It does not prescribe medication or therapy and must not be used to change any treatment.
  • Always seek the advice of your doctor or qualified healthcare professional with any questions about a medical condition.

9. No doctor–patient relationship

Use of the App does not create a doctor–patient, therapist–client or any other professional healthcare relationship between you and PulmoWise or any contributor to the App.

10. Emergency situations

The App is not designed for use in medical emergencies. If you are experiencing chest pain, severe breathlessness, fainting, confusion or any other emergency, call 999 (UK) or your local emergency number immediately.

11. Intellectual property

All intellectual property rights in the App — including software, design, text, graphics, logos and AI prompts — are owned by PulmoWise Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal use in accordance with these Terms.

12. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the App will be uninterrupted, error-free or secure.

13. Limitation of liability

To the maximum extent permitted by law, PulmoWise Ltd shall not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of data, profits, revenue or goodwill arising from your use of (or inability to use) the App. Our total aggregate liability for any claim relating to the App is limited to the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

14. Privacy

Our processing of your personal data is described in our Privacy Policy, which forms part of these Terms.

15. Account suspension or termination

We may suspend or terminate your account if you breach these Terms, misuse the App, or where required by law. You may delete your account at any time. On termination, your right to use the App ends and we will delete your data in accordance with our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

17. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident elsewhere in the UK may bring proceedings in their local courts.
